By now, y’all are likely well aware of the recent shocking admissions by Volkswagen. VW installed “defeat devices” in their “TDI” (turbo diesel injection) line of vehicles, which triggered when the cars were tested. In reality, the emissions levels of the TDI vehicles were up to forty (40) times what the defeat device allowed to be tested and what Volkswagen represented to American consumers. Our firm, along with our (awesome) office mates with Amini & Conant, LLP, has filed a lawsuit in the Travis County Court-at-Law on behalf of a client and friend against Volkswagen for fraud, violations of the Texas Deceptive Trade Practices Act, and breach of warranty. While a number of class-action lawsuits have already been filed, we believe that taking the cases on an individual basis here in Travis County (as opposed to Federal Courts, likely in New Jersey or Virginia) will better serve our clients. We believe we can keep cases here (and out of the years-long class action process), so long as we limit damages to under $75,000.00 for each claim.
